The defendant, Harry Martin Brockman, appeals his Jefferson County District Court conviction and sentencing on two counts of aggravated robbery under section 18-4-302, 8 C.R.S. (1978), and two counts of violent crime under sections 16-11-309 and 18-1-105(9), 8 C.R.S. (1984 Supp.). The defendant maintains that his conviction must be vacated because of the courts refusal to permit him to present surrebuttal evidence intended to rehabilitate his chief alibi witness, whose credibility had been impeached by the Peoples rebuttal evidence. Because the district court abused its discretion in denying the defendants request for surrebuttal, we reverse the defendants conviction and remand the case for a new trial.
